By using Burnaby Solution (Thailand) you acknowledge and agree that you are subject to the following terms and conditions, as well as our Privacy Policy, which also governs your use of the Site, and is incorporated by reference (These Terms and Conditions with the Privacy Policy shall be referred to as the “Terms“). The User must be at least eighteen (18) years of age (or the age of majority in the User’s country) to be able to use the Services on this Website. Please read these Terms carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than court.

Scope of Services

Content and Services may change, modify, add or delete these Terms at any time as necessary to comply with any law or regulation binding on us or to reflect a change in our operating practises, provided that we make reasonable efforts to post material changes on the Site. Please review these Terms each time you use the Website to ensure that you have read the most current version. Your continued use of any portion of the Website following any such change to these Terms constitutes your acceptance of those changes and their application to you.

Although we exercise prudence in using our expertise in providing the Services, we do not verify or guarantee that all information provided by Providers available on the Site is accurate, complete, correct or up-to-date, and we are not responsible for any errors (including placement and typographical errors), disabilities (either due to temporary and/or partial, damage, repairs or improvements to the Site or otherwise), inaccurate, misleading or false information provided by Providers, or the failure of Providers to provide information.

Changing market conditions or circumstances may result in changes in a short period of time that may cause the information provided by the Sellers on the Website to be inaccurate or inapplicable. The Services provide an online platform to connect you with sellers. To the extent permitted by law, we are not responsible or liable for the acts or omissions of any Seller, and you are solely responsible for any obligations or liabilities to Sellers. We make no representations and should not be construed as making any recommendations or suggestions regarding the quality of services or the evaluation of any Vendor listed on the Site, and we are in no way responsible or liable for any information, content, products, services or other materials provided or made available by Vendors. Vendors may be presented in the form of various classes based on factors including, but not limited to, their reviews, ratings or other factors. The rating provided is calculated based on automated algorithms that may be updated and changed at our discretion

To the extent permitted by law, we have the right, in our sole discretion and for any reason, to reject a user or booking (or in certain cases, to cancel the booking confirmation) without providing any reasons for the rejection/rejection/cancelation. The reasons for rejecting a User or Booking or canceling a Booking Confirmation may include, but are not limited to: violation of these Terms, trade or economic sanctions by global or national authorities, embargo, prohibitions in regulations, fraud or theft (or evidence or suspicion of fraud or theft), suspicion of criminal activity, suspicious orders, services that are not or no longer provided by the Provider, users providing inaccurate, erroneous or misleading information, problems with electronic credit card communications, information or transactions, inappropriate behavior, threats, insults, denial of information, practical impediments, communication difficulties or failures, a genuine error (described below), previous violations of these Terms, or inclusion on “blacklists” or “watch lists” of governments or international organizations. We may at any time either temporarily or permanently delete or remove a user’s account from the Site. Removed users may not attempt to use the Website under a different name or through other users.

Any payment in connection with the booking or reservation of the Services shall be made directly to Burnaby Solution (Thailand)’s bank account or Burnaby Solution (Thailand)’s payment channels. Except where Burnaby Solution (Thailand) is required to hold such payments in trust for the relevant Provider under a separate agreement, all such payments shall be the property of Burnaby Solution (Thailand) and the amounts shall become due and payable to the relevant Provider when the Services to which a payment relates are provided, or at such other time as the relevant Provider may require. If payment is not made directly to Burnaby Solution (Thailand)’s bank account or through Burnaby Solution (Thailand)’s payment channels, Burnaby Solution (Thailand) will not be responsible for the validity of the reservation.

For payment of bookings made through the website, Burnaby Solution (Thailand) will charge your credit card for the full price at the time of booking and booking confirmation (any refund will depend on the terms of existing reservations). You must check the booking details carefully each time before making a reservation. Burnaby Solution (Thailand) will make the refund, if applicable, within a reasonable period of time. For certain reservations, you may be required to pay the supplier directly. To protect and encrypt your credit card information when it is transmitted to us, we use encryption technologies such as Transport Layer Security (“TLS”) or Secure Sockets Layer (“SSL”) to ensure the integrity of your information.Payment by Credit Card & Fraud

In the event of credit card fraud or unauthorized use of your credit card by a third party, you must contact your bank or card issuer immediately upon discovery of such unauthorized use. In such event, Burnaby Solution (Thailand) shall have no responsibility in the event of credit card fraud or unauthorized use of your credit card by a third party, whether or not such fraud or unauthorized use occurred through Burnaby Solution (Thailand)’s services (including, without limitation), unless due to Burnaby Solution (Thailand)’s fraud, negligence or willful misconduct or as otherwise required by law. Unless otherwise required by law, Burnaby Solution (Thailand) is not obligated to provide you with a refund or reimbursement as a result of such fraud. As part of our goodwill, we may offer you some form of compensation, subject to our review and approval. You will be entitled to seek compensation only if such reservations were made through our secure servers and the fraud or unauthorized use of your credit card resulted from our default or negligence and you were not at fault in using the secure server or otherwise entitled to compensation by law. We will not be liable for the fraud or unauthorized use of your credit card if it occurred through applications or servers other than our own, or if it resulted from any error or negligence on your part. If you suspect an unauthorized booking or fraud on Burnaby Solution (Thailand), you must contact Burnaby Solution (Thailand) Customer Service.

To make a reservation, you must be over eighteen (18) years of age and of full legal capacity (or have the permission of your legal guardian). You must use a credit or debit card that you own and that is issued in your name, and make sure that you have sufficient funds to cover the transaction fees. Any fees you incur for authorizing a transaction that results in an overdraft on your account are not the responsibility of Burnaby Solution (Thailand)

Cancellation of reservations/purchases and non-use of services

When you make a reservation/purchase of a product or service, it means that you accept and agree to the cancellation and non-use terms and conditions, including any additional terms and conditions of the applicable service provider, depending on the terms of the applicable service provider. Some prices and fees or special offers cannot be cancelled, refunded or modified. Cancellation fees may apply in accordance with booking policies. Prepayment and Service Provider’s No Service Policy Or you may not be entitled to a refund of the prepayment, so we recommend that you check the information. (Reservation/Purchase) your product or service in detail whether there are such conditions or not before you make a reservation/purchase. However, Burnaby Solution (Thailand) will not be responsible for any late use of the service or if your reservation is cancelled. Or a fee will be charged by the service provider if the customer does not use the service.

Force Majeure

Neither party shall be responsible or liable for or deemed in breach of these Terms because of any delay or failure in the performance of these Terms due to any event or circumstance the occurrence and the effect of which the party affected thereby is unable to prevent and avoid, including, without limitation acts of God; government regulations, curtailment of transportation facilities, strikes, lock-outs or other industrial actions or trade disputes of whatever nature (whether involving employees of a party or a third party), terrorist attacks, haze, sabotage, riots, civil disturbances, insurrections, national emergencies (whether in fact or law), blockades, acts of war, (declared or not), etc. (a “Force Majeure Event”). The non-performing party shall give the other party written notice describing the particulars of the Force Majeure Event as soon as possible.
